Terms and conditions of repairs, installations electric fencing.

Sure, this is the not so nice page! The bottom line is we are very strict with payment though so please take careful note! Interesting that the only clients who have queries and issues here are the same ones who we have problem with payments – in other words, the terms of payment are not negotiable anymore….

Liability:

Midrand electronics accepts no liability for the use of information provided on this web site and disclaims itself from any damages claimed or incurred from the use of this information. Clients requiring assistance with electric fences or any electronic items should request or seek advice in assistance as electricity can be lethal under correct conditions.

Midrand Electronics accepts no liability to any third party or client that may claim damages against the owner, Midrand Electronics or there staff and includes claims of damage to property or personal injury claims against the client made by any party.

All repairs conducted by Midrand Electronics including fences, electronic equipment, lighting equipment, home automation equipment (but not limited to) carry a 3 month warranty. Damages by lightning, moisture, misuse, external forces are not covered under warranty and the warranty is only applicable to work carried out within the specific region on item repaired.

All NEW installations, new equipment supplied carry a 1 year warranty (or manufacturers guarantee/warranty if exceeds period). Warranty is under the condition that any damage received is not from external force, misuse, moisture damage or tampering by any party other than Midrand Electronics. The tampering or opening of any item supplied by Midrand Electronics immediately and without exception voids any warranty on any item including the installation.

Orders:

All orders requested on behalf of a company, trust or any other party other than a natural person and that the natural person, the individual ordering such repairs, warrant that they are permitted to do so and do so with authority of the company. All orders confirmed should therefore be conducted in writing to protect the same individual from claim against payment. Should the entity claim no knowledge or liability for the work carried out, the individual placing the verbal order immediately becomes liable and binds themselves as surety in there personal capacity for all and any outstanding amounts

Access arrangements should be made in advance and should access be denied or not achievable to the property in order to carry out the repairs/installation and prevents Midrand Electronics from commencing work, the client could be made liable for R350 labour charge on each occurrence (over and above any quotations), regardless of no work being conducted.

Payments:

All work carried out by Midrand Electronics is payable immediately on completion of work carried out, collection or delivery.

Payments of 50% – 70%  may be required by Midrand Electronics (most specifically new installations and orders) and should 50% – 70%  deposit be required, no work will commence until such time as the payment is received.

On completion of work (installation and repairs) any outstanding amount should be settled immediately with Midrand Electronics by cash, electronic funds transfer. Failure to settle the FULL required amount within 3 days (and should reflect in Midrand Electronics account) of invoice shall result in:

• Immediate final demand letter issued, or when deemed necessary, which incurs an immediate administration fee of R200 over and above the existing invoice that further becomes due and payable immediately without deduction

• Failure to make payment on the terms of the final demand (7 days) will result in the client being immediately, without further notice, being handed over to debt collectors for immediate collection of outstanding amounts including a further R150 hand over charge immediately becoming due and payable over and above final demand charge and invoice amounts.

• The debt collector is under instruction to blacklist any non paying clients under the terms of the law (currently 20 days) and recover the outstanding amount by any lawful means and that the client becomes liable for all costs incurred in the collection of such costs.
• The client immediately forfeits all warranty periods with new installations and repair work, including after the outstanding amounts are recovered by Midrand electronics after the final demand period has been exceeded.
• Clients acknowledge and accept that an accepted means of delivery for demands, legal notices and correspondence relating to the installation/repairs will be the clients email address OR fax OR hand delivery to the premises (excludes the clients acceptance of the job to proceed and work be carried out which may be done verbally)

Any delays or leniency offered by Midrand Electronics does not constitute a waiver of any conditions as stated and laid out by Midrand Electronics

All items installed and components fitted remain the property of Midrand Electronics until full and final payment is received. Failure to complete full and final payment (reflecting in Midrand Electronics account) with 3 days of invoice (as per above) and Midrand Electronics reserves the right and without any further notice to immediately remove any parts or units installed against the invoice and to do so at the clients cost of labour and could be charged for further re-instating the same items.

All items repaired at our work place and not collected within 30 days and the client being notified that it ready for collection will be sold to defray expense without further notification.

All clients and parties accept the terms and conditions of repair and installation as per above on placing a verbal or written order
